01 · Warranty
We stand behind
our work.
If a covered D&S repair fails because of our workmanship, contact us and give us the opportunity to inspect it. If the problem is determined to be the result of our workmanship, we will correct the covered repair without charging additional repair labour for that correction.
Unless a different written warranty is stated on your invoice, D&S provides a 180-day workmanship warranty on the specific repair we performed. Any greater warranty or protection required by Ontario law still applies.
New or reconditioned parts supplied by D&S are also subject to applicable manufacturer/supplier warranties and any warranty required by law.
What our voluntary warranty does not cover
- Improper use, misuse, abuse, racing, competition, collision, rollover, impact, overloading or operation outside the manufacturer's intended use.
- Continued operation after a warning, abnormal noise, leak, overheating condition or other known problem.
- Improper storage or seasonal preparation; stale, contaminated or incorrect fuel; water, dirt or debris in fuel; corrosion, freezing, moisture, flooding, weather, rodent or insect damage.
- Incorrect, contaminated or insufficient oil, coolant, fuel, additives or other fluids; failure to check levels or perform required maintenance.
- Normal wear, maintenance and consumable items such as belts, blades, chains, cables, filters, spark plugs, fluids, tires, tubes and similar items unless a defect or mandatory warranty applies.
- Pre-existing problems, hidden damage, unrelated failures, previous improper repairs or modifications.
- Aftermarket tuning, accessories, attachments or modifications that contributed to the failure, or defeat/removal of safety equipment.
- Extraordinary commercial, rental or severe-duty use beyond the equipment's intended design unless specifically accepted by D&S.
02 · Somebody else touched it?
Let us see it first.
If you believe there is a problem with a D&S repair, bring it back to us before somebody else takes the affected system apart.
Our voluntary warranty on the affected repair/system may be void if another shop or person disassembles, adjusts, modifies, rewires, reprograms, repairs or otherwise materially interferes with our repair before D&S has had a reasonable opportunity to inspect it.
Unrelated routine maintenance elsewhere does not automatically void an otherwise valid D&S warranty unless that work contributed to the failure or prevents a reliable diagnosis.
D&S does not reimburse third-party diagnosis, repair, towing, transportation, downtime or replacement costs unless we authorized the expense beforehand or applicable law requires otherwise.
03 · D&S powersport & lawn-and-garden batteries
One original purchase.
One clear battery warranty.
This voluntary limited warranty applies to new D&S-branded powersport and lawn-and-garden batteries sold at retail by D&S. It is for the original purchaser and original intended application, and is not transferable.
What is covered
If, during the applicable period, D&S testing confirms that the battery has failed to accept or hold a charge because of a defect in materials or workmanship, D&S will provide one no-charge replacement battery of the same model or a reasonably comparable current model. If no reasonably comparable replacement is available, D&S may instead refund or credit up to the original battery purchase price.
The warranty clock starts on the original invoice date. A replacement does not restart or extend it. A replacement battery is covered only for the time remaining on the original warranty, and a successful replacement, refund or credit exhausts this voluntary battery warranty. The failed battery must be surrendered to D&S. If the customer chooses an upgrade, the customer pays the difference.
For this policy, commercial use includes use in a trade, business, farm, municipality, institution, rental/lease operation or other income-producing activity, regardless of who physically operates the equipment.
What is not covered
- A battery that is merely discharged but accepts and holds a charge after proper charging and testing.
- Normal loss of capacity, ordinary wear or end-of-service-life deterioration rather than a defect in materials or workmanship.
- Sulfation, freezing, undercharging, overcharging, reverse polarity, short-circuiting, excessive parasitic draw or failure of the vehicle/equipment charging or starting system.
- Improper initial activation, filling, charging, installation, terminal connection, maintenance, storage or seasonal care.
- Use in the wrong application; use outside the battery's voltage, polarity, size, terminal, capacity, cranking or duty-cycle specifications; or accessories/electrical loads beyond the intended application.
- Collision, impact, vibration beyond the intended application, cracked or damaged cases, loose/broken terminals, fire, flooding, water intrusion, contamination, acid loss, tampering or other external damage.
- Neglect, misuse, abuse, racing, competition, jump-starting or charging contrary to instructions, or continued use after a known electrical or charging problem.
- A removed, altered, unreadable or mismatched D&S label, serial number or date code where it prevents reliable identification of the battery or claim.
Unless required by law, this voluntary warranty does not pay for diagnosis outside D&S, removal/reinstallation, boosting, towing, transportation, shipping, lost time, loss of use, lost income or damage caused by an unrelated vehicle/equipment defect. D&S installation workmanship remains covered by the separate workmanship warranty above.
04 · D&S-branded equipment warranty
Our name on the machine.
Our warranty behind it.
This voluntary limited warranty applies to new, complete D&S-branded outdoor power equipment, replacement engines and D&S-branded attachments or accessories sold by D&S. D&S batteries are governed by the separate battery warranty above.
What is covered
During the applicable period, D&S warrants to the original purchaser that covered equipment will be free from defects in materials and workmanship under normal, intended use and proper maintenance. If D&S confirms a covered defect, D&S will, at its option, repair the defective part or unit, replace it with a new, rebuilt or reasonably comparable unit/part, or refund up to the original purchase price where repair or replacement is not reasonably practical.
Covered parts and D&S repair labour are included. The customer is responsible for safely transporting the equipment to and from the D&S shop unless D&S agrees otherwise in writing or the law requires another remedy. Replaced parts become D&S property.
The warranty begins on the original invoice date, applies only to the original purchaser and is not transferable. Repair, replacement, resale, seasonal storage or delayed first use does not restart or extend the original term. Any replacement part or unit receives only the balance of the original term, unless a longer period is required by law or expressly stated in writing by D&S.
Conditions of coverage
The owner must use, maintain and store the equipment according to its manual and warning labels; use correct fuel, oil, fluids, power and attachments; retain the original proof of purchase and reasonable maintenance records; stop using the equipment when a problem may cause further damage; and give D&S a reasonable opportunity to inspect and correct a claimed defect before the affected system is materially altered.
Service by another qualified person does not automatically cancel the warranty. Coverage may be denied only where unauthorized work, an unsuitable part/modification or the inability to reliably inspect the original condition caused or contributed to the failure or materially prevents proper diagnosis.
What is not covered
- Routine maintenance, adjustments and tune-ups, including carburetor cleaning, fuel-system cleaning, valve adjustment, sharpening, lubrication and seasonal preparation.
- Normal wear and consumable items, including filters, fluids, spark plugs, belts, blades, chains, bars, sprockets, trimmer line/heads, cables, shear pins, tires, tubes, brushes, clutches and similar service items, unless a defect or mandatory warranty applies.
- Stale, contaminated, incorrect or water-affected fuel; incorrect fuel mixture; incorrect, contaminated or insufficient oil/coolant; ethanol-related deterioration; corrosion; improper storage; freezing; moisture; rodents or insects.
- Misuse, abuse, neglect, operator error, collision, impact, rollover, foreign-object damage, overloading, overheating, racing, competition or operation outside the equipment's intended purpose, capacity or environment.
- Failure to follow the manual, safety warnings or maintenance schedule; failure to check fluids/fasteners/guards; or continued operation after a warning, leak, abnormal noise, vibration, blockage, loss of lubrication or other known problem.
- Unauthorized alteration, tuning, disassembly or repair; removal/defeat of safety equipment; or use of an unsuitable attachment, accessory, replacement part, extension cord, power source or water supply that caused or contributed to the failure.
- Fire, theft, vandalism, flood, severe weather, power surge, transport damage after delivery, improper loading/tie-down or another event outside D&S's reasonable control.
- Cosmetic damage or ordinary fading, scratching, surface rust, discolouration, noise or vibration that does not materially affect safe operation or function.
- Rental/loaner-fleet use, or commercial/severe-duty use beyond the model's intended design, unless D&S expressly accepted that use in writing.
- A removed, altered or unreadable serial/model label where it prevents reliable identification, service-history confirmation or claim assessment.
To the fullest extent permitted by law, this voluntary warranty does not include pickup/delivery, third-party repairs, substitute equipment, downtime, lost profits, lost production, lost contracts or other indirect/consequential costs. A separate written warranty on the invoice or a mandatory legal warranty prevails to the extent it gives the customer greater rights.
05 · D&S equipment safety, injury & property damage
Power equipment can hurt people.
Operate it like it can.
D&S-branded equipment may use fuel, electricity, engines, high-speed cutting parts, pressure, heat, sharp components and significant moving force. Incorrect operation can cause fire, electric shock, environmental harm, serious injury, death or major property damage. Purchasing equipment is not a substitute for reading the manual, training the operator or checking that the machine is suitable and lawful for the intended job.
The owner and every operator are responsible for choosing a safe work area, using the correct machine and attachments, following all instructions, maintaining the equipment and stopping when something is not right.
If a guard, safety switch, warning label or protective device is missing, damaged or defeated, do not operate the equipment.Every owner and operator is expected to
- Read, understand and follow the complete operator's manual, warning labels and instructions before use, and keep them available for every operator.
- Use only for the intended purpose, within rated capacity and with compatible guards, attachments, fuel, fluids, power supply and safety equipment.
- Inspect the equipment before each use; keep guards and safety devices installed and working; perform required maintenance; and correct loose, worn, damaged or leaking components before operation.
- Wear appropriate personal protective equipment, keep bystanders and animals at a safe distance, and check the work area for people, utilities, vehicles, structures, debris and other hazards.
- Permit operation only by a competent, properly trained, physically capable and appropriately aged person who is not impaired by alcohol, drugs, fatigue, illness or distraction.
- Stop immediately if the equipment behaves abnormally, is damaged, loses a guard, leaks, overheats, vibrates excessively, makes an unusual noise or may otherwise be unsafe. Do not defeat a safety switch or continue just to finish the job.
- Comply with all laws, workplace rules, licensing requirements and manufacturer restrictions that apply to the equipment, location and intended use.
To the fullest extent permitted by law, the owner/operator is responsible for injury, death, property damage, environmental damage, fire, loss or expense caused by their own—or another user's—misuse, abuse, careless/reckless/negligent operation, inadequate training or supervision, failure to inspect or maintain, use contrary to warnings, unauthorized modification/repair, unsuitable attachment/application, removal of safety equipment, or continued operation after a known or obvious problem.
An owner who lends, rents, transfers or allows another person to use the equipment is responsible for providing the manual and warnings, disclosing known defects, ensuring the person is competent and legally permitted to operate it, and not entrusting it to someone who is impaired, untrained or otherwise unsafe. Commercial owners are also responsible for workplace training, supervision, inspection and legal compliance.
Where permitted by law, the owner/customer will indemnify and hold D&S harmless from a third-party claim, damage or expense to the extent caused by the owner's or operator's breach of these responsibilities, misuse or unauthorized alteration. This does not make the customer responsible to the extent a loss was caused by D&S's own negligence or by a product defect for which D&S is legally responsible.
06 · Electrical & electronics
Electrical parts
are different.
Electrical and electronic components are generally excluded from our voluntary parts return/warranty once installed, connected, programmed or energized. A perfectly good component can be damaged by an unrelated wiring fault, short, poor ground, reverse polarity, charging-system problem, voltage spike, water intrusion or another electrical issue elsewhere in the machine.
This does not eliminate a valid manufacturer warranty, D&S's responsibility for our own installation workmanship, or any right that cannot lawfully be excluded.
Replacing one electrical component also does not mean we are warranting every wire, connector, battery, charging component, module, sensor or related component unless that broader system was specifically included in the repair.
07 · Estimates, diagnostics & teardown
Sometimes taking it apart
reveals more nonsense.
Estimates are based on what we can reasonably see, test and determine. Disassembly may reveal hidden damage, corrosion, seized or broken fasteners, contamination, previous repairs or additional failed components that could not reasonably be identified beforehand.
D&S will obtain any additional authorization required by law before proceeding beyond an authorized scope or amount.
Diagnosis, inspection, testing, teardown and reassembly are skilled labour and may be chargeable even when you decline the repair, the machine is uneconomical to repair, parts are unavailable or an intermittent problem cannot be reproduced.
08 · Customer-supplied parts
Your part.
Our labour.
We reserve the right to refuse customer-supplied parts. If accepted, D&S does not warranty the quality, authenticity, fit, durability or supplier warranty of a part we did not supply.
We stand behind our installation workmanship. Additional labour caused by an incorrect, defective or unsuitable customer-supplied part may be chargeable.
09 · Deposits & special orders
Some parts need money up front.
D&S may require deposits before ordering parts or beginning substantial repairs. Parts orders over $150 may require a deposit. Special-order, custom, supplier-restricted or non-returnable parts may require payment in full before ordering.
Special-order payments and deposits may be non-refundable where the item cannot reasonably be cancelled or returned, subject to applicable consumer law.
10 · Finished equipment, storage & unpaid accounts
Please come get
your stuff.
When equipment is finished, or we notify you that no further work will be performed, you have 10 calendar days from our notification to collect it or make another written arrangement accepted by D&S.
Beginning on Day 11, storage charges may begin at the then-disclosed D&S storage rate and continue until the equipment is lawfully picked up, released, sold or otherwise disposed of.
Unless another arrangement has been made, payment is due when work is completed and before equipment is released. An invoice outstanding for 30 days is considered delinquent. D&S may suspend further service, pursue collection and exercise any repairer's/storer's lien and other rights available under Ontario law.
Where equipment remains unclaimed or repair/storage charges remain unpaid, D&S may retain possession and exercise its rights under Ontario's Repair and Storage Liens Act. Once all applicable statutory waiting periods, notices and other legal requirements are satisfied, D&S may sell the equipment by public or private sale as permitted by law. A lawful lien sale can permanently end the customer's ownership interest in the equipment.
We do not simply declare your machine ours after an arbitrary number of days. We use the legal process available to Ontario repair and storage businesses.11 · Equipment while it's here
Reasonable care.
Not an insurance policy.
D&S will take reasonable care of customer equipment while it is in our possession. To the fullest extent permitted by law, D&S is not responsible for loss or damage caused by circumstances outside our reasonable control, including theft despite reasonable security, vandalism, severe weather, flood, wildlife, utility failure or fire not caused by D&S.
Please remove cash, documents, electronics, tools and unrelated valuables before drop-off. We may photograph equipment condition at intake or during service to document pre-existing damage, diagnosis and repairs.
12 · Testing & operation
We may need to
run the thing.
By authorizing service, you authorize D&S to reasonably start, operate, move, road-test or load-test equipment when required for diagnosis, repair or verification of our work, subject to safety and applicable law.
After pickup, the owner/operator is responsible for operating and maintaining equipment according to manufacturer instructions and appropriate safety requirements.
13 · Appointment only
Yes, we're here.
Appointment only does not mean nobody is here. Quite the opposite. It lets us control interruptions, manage workload and keep technicians fixing machines instead of spending the day answering the door.
Customers and visitors must stay in designated customer areas and follow staff directions. Shop bays, storage areas, fenced areas and other non-public portions of the property are restricted without permission.
14 · Trips, falls & shop hazards
It's a working shop.
There may be machines, trailers, tools, cords, snow, ice, wet or uneven surfaces, fluids, hot components, moving equipment, sharp objects and other ordinary shop/yard hazards.
Visitors must use reasonable care, obey signs and staff directions, supervise children and keep pets controlled. Nothing here attempts to exclude a responsibility D&S cannot lawfully exclude.
15 · Video surveillance & privacy
Smile.
You're probably on camera.
For safety, security, theft deterrence, incident investigation and protection of customers, employees, equipment and property, D&S uses overt video surveillance.
Cameras may record people, vehicles and activity at property access points, exterior areas, the yard and appropriate customer/shop areas from the time a person enters the monitored property. Camera coverage does not guarantee that every location, event or angle will be recorded.
Surveillance may be used for legitimate safety, security, insurance, dispute-resolution, law-enforcement and other lawful purposes. Access is limited to authorized persons and recordings are retained only as reasonably necessary. Cameras will not intentionally be directed into areas where someone has a heightened expectation of privacy.
This website collects limited, anonymous traffic statistics such as page views, active time on a page, referral source, navigation between pages, and clicks on links or contact buttons. A one-way scrambled visitor identifier is used to produce aggregate counts. Readable IP addresses are not stored, no advertising profile is created and no tracking cookies are used. Global Privacy Control and Do Not Track signals are respected.
Questions about surveillance or privacy can be directed to dandspowersport@gmail.com.
16 · Respect our people
Being unhappy is allowed.
Being abusive isn't.
D&S has zero tolerance for threats, intimidation, harassment, discriminatory conduct, aggressive behaviour, screaming, repeated profanity directed at staff, sexual harassment, stalking, property damage or other abusive conduct toward staff, contractors, customers or visitors.
D&S may end a call or conversation, require a person to leave, restrict future communication to writing, cancel future appointments, refuse future non-mandatory service or contact police where reasonably necessary for safety.
You are absolutely allowed to disagree with us. You can question an invoice, complain, ask for an explanation or make a warranty claim. This policy is about abusive conduct, not respectful disagreement.
17 · Pickup, delivery & third-party transport
We keep our technicians
in the shop.
D&S does not currently operate its own general pickup/delivery route. We can help connect customers with independent transport providers.
Unless D&S specifically agrees otherwise in writing, those providers are independent third parties and the transportation arrangement is with them. D&S is not responsible for their scheduling, pricing, acts, omissions or transportation damage except where the law says otherwise.
18 · Turnaround times
An estimate.
Not a blood oath.
Any turnaround time provided by D&S is a good-faith estimate unless we expressly guarantee a completion date in writing. Repair timelines can change for plenty of very real reasons:
- Parts backorders
- Shipping delays
- Additional problems discovered during repair
- Supplier issues
- Customer authorization delays
- Weather
- Workload
- The occasional machine that wakes up and chooses violence
Subject to rights that cannot legally be excluded, D&S is not responsible for lost income, loss of use, substitute-equipment rental, missed events, business interruption or other indirect/consequential loss arising solely from an ordinary repair delay or equipment breakdown.
Professional customers with separate maintenance agreements or service arrangements are governed by those agreements where applicable.
19 · Unsafe or unsuitable work
We can say no.
D&S may refuse or stop work we reasonably consider unsafe, unlawful, outside our capabilities, contrary to manufacturer/safety requirements, dependent on unavailable parts/information, or likely to create an unacceptable safety or liability risk.
We may also refuse requests to defeat or remove required safety equipment. Please disclose known fuel leaks, hazardous contamination, biohazards, chemical exposure or other unusual hazards before drop-off.
20 · Photos & repair records
We document our work.
D&S may photograph/video equipment, serial/model information, damage, disassembly, test results and completed repairs where reasonably necessary for diagnosis, service records, warranty administration, training, security or dispute resolution, subject to applicable privacy law.
A normal repair authorization is not blanket permission to publicly advertise a customer's identifiable personal information.
One last thing
The point is clarity.
Not an escape hatch.
These policies are intended to create clear expectations — not give us an excuse to avoid standing behind our work.
If we made the mistake, we're going to own it.
If the machine sat outside for eight months with last year's fuel in the carburetor, a mouse condominium under the flywheel and three different people have "just tried a couple things" since it left here... we're probably going to have a different conversation.
These policies form part of D&S's general service terms. A specific written work order, estimate, invoice, warranty or service agreement may contain additional terms. Nothing on this page limits, excludes or waives any consumer protection, warranty, duty, remedy or other right that cannot legally be limited, excluded or waived under Ontario or Canadian law.
